Terms of Service — United States

These terms apply to customers in the United States. Customers outside the US are covered by our standard terms.

1. Who you are contracting with

The Ring Rescue US technology and brand are owned by AI Ring Rescue (United Kingdom). In the United States, the service is sold and operated by AI Ring Rescue (the "US Operator"). Your contract for service is with AI Ring Rescue.

2. Acceptance

By purchasing, accessing or continuing to use the service you agree to these terms. If you agree on behalf of a company you confirm you have authority to bind it. If you are an individual you confirm you are at least 18 years old and legally able to contract.

3. What we provide

We build, configure and host an AI phone receptionist for your business: answering calls, answering routine questions from the information you supply, booking jobs, and sending you call summaries. The one-time setup fee covers the initial build and launch. The monthly fee covers hosting, included call handling and ongoing tuning. Prices are shown in US dollars and are exclusive of any sales or use tax, which is added at checkout where applicable.

4. Your account and information

You must provide accurate information about your services, prices, availability and service area and keep it current. You are responsible for keeping your credentials confidential and for all activity under your account.

5. Acceptable use

You must not use the service to:

• violate any federal, state or local law, or facilitate unlawful activity;
• make or support unsolicited telemarketing, autodialed or prerecorded calls, or otherwise use the service in a way that would violate the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, state mini-TCPA statutes, or federal and state do-not-call rules;
• record calls without the consent required in the relevant state, including all-party consent states such as California, Florida, Illinois, Pennsylvania and Washington;
• send spam, commit fraud, or engage in deceptive or unfair practices;
• infringe intellectual property or privacy rights;
• interfere with the security or integrity of the service, including malware, probing, scanning, scraping or circumventing technical limits;
• resell, sublicense, redistribute or reverse engineer the service.

You are solely responsible for obtaining any consents required to place, receive, record or transcribe calls involving your customers, and for the content of your call greetings and disclosures.

6. AI-generated responses

The receptionist generates responses automatically. Output may be inaccurate or incomplete and is not professional, legal, financial, medical or safety advice. You are responsible for the information you supply, for reviewing bookings and summaries, and for commitments made to your customers. We may filter, restrict or refuse output. If you believe content produced or hosted through the service infringes your rights, contact us and we will review and remove it where appropriate under the DMCA; repeat infringement may result in termination.

7. Intellectual property

AI Ring Rescue retains ownership of the Ring Rescue US software, prompts, configuration templates, documentation and brand; the US Operator holds only the rights granted in its license agreement. You receive a limited, non-exclusive, non-transferable, non-sublicensable right to use the service for your own business while your subscription is active. You keep ownership of your business information and call data and grant us a limited license to host and process it solely to deliver the service.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. Some states do not allow certain disclaimers, so parts of this section may not apply to you.

9. Payment, billing and cancellation

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing frequency, sales tax, renewals, cancellations and refunds are governed by Paddle's Buyer Terms. Monthly subscriptions renew automatically each month at the then-current price until you cancel, and you authorize recurring charges to your payment method. You may cancel at any time from your client portal; cancellation stops future billing. See our US Refund Policy.

10. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time. On termination your access ends; you may request an export of your call data within 30 days, after which it may be deleted. If the license ends, service may be transferred to another operator on the same terms, or terminated with pro-rata refund of any prepaid unused period.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY IS LIMITED TO THE FEES YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS, MISSED CALLS, LOST BOOKINGS, LOST DATA OR LOSS OF GOODWILL. Nothing excludes liability that cannot be excluded under applicable law.

12. Indemnification

You will defend, indemnify and hold harmless AI Ring Rescue from claims, damages and costs (including reasonable attorneys' fees) arising from your content, your use of the service, calls placed or recorded on your behalf, TCPA or call-recording consent claims relating to your customers, or your breach of these terms.

13. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, and by applicable US federal law. Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer or Commercial Arbitration Rules, seated in California, and judgment may be entered on the award. You and we waive any right to a jury trial and to participate in a class, collective or representative action. Either party may bring a claim in small-claims court instead. You may reject this arbitration agreement by written notice within 30 days of first accepting these terms, in which case disputes go to the state or federal courts located in California.

14. General

You may not assign these terms without our consent; we may assign them in a merger, sale or license transfer. Neither party is liable for delays caused by events beyond its reasonable control. If a provision is unenforceable, the rest remains in force. These terms are the entire agreement between us regarding the service.
